Agenda Title:

Approve Request from JLZ, LLC for a Variance to Waive the Requirement to Install Sidewalk Along Centre Street adjacent to 840 Centre Street, Rapid City, per City Ordinance 12.08.060.

Summary:

A request was received in the Engineering Office on 2/12/2016 requesting the requirement to install sidewalk along Centre Street per City of Rapid City Ordinance 12.08.060 be waived. A 5’ sidewalk is required to be constructed along this street at the time of building permit, with the property having approximately 480’ of street frontage. The requested variance will allow for an industrial business to be re-built following a fire that destroyed more than 50% of the building without the installation of sidewalk in the adjacent right-of-way.

 

Adjacent Centre Street is an industrial road with 22’ of pavement with no curb and no gutter and ditches and a storm sewer for drainage. Currently the street is void of any sidewalk, with the nearest sidewalks located on Centre Street approximately 500’ to the east. All of the surrounding properties are built on today and sidewalk on adjacent properties does not seem foreseeable in the conceivable future.   

 

The Rapid City Council has the authority to order in sidewalk at any time, should sidewalk in this area become necessary.
